Official Rules

Online entries will be subject to standard Internet access and usage charges imposed by your Internet service provider.

 

  1. Eligibility:  The Deal or No Deal DealMania Sweepstakes (“Sweepstakes”) is open only to persons who, at the time of entry, are legal residents of the fifty (50) U.S. and Canada (except in the province of Quebec) and who are eighteen (18) years of age or older as of the start of the Sweepstakes Period.  Officers, directors, and employees of Sweepstakes Entities (as defined below), immediate family members (spouses and/or parents, children, and siblings, and their spouses, regardless of where they reside) and/or those living in the same household of such persons (whether or not related thereto) are not eligible to participate or win.  Sweepstakes Entities, as referenced herein, shall include Call Genie Inc., Don Jagoda Associates, Inc., NBC Universal, Inc., and Endemol USA Inc. and their respective parent, subsidiary, and affiliate companies, their administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes.  By entering the Sweepstakes, participants are bound by and agree to these Official Rules.  All federal, state, provincial and local laws and regulations apply. Void in Quebec and where prohibited by law.

 

  1. Sponsor: The Sponsor of the Sweepstakes is Call Genie Inc. (“Sponsor”), 200 2710-17 Avenue SE, Calgary, AB   T2P 0A6, Canada. 

 

  1. Sweepstakes Period: The Sweepstakes begins at 9:00:01 A.M. ET on November 30, 2009 and ends at 11:59:59 P.M. ET on September 1, 2010 (the “Sweepstakes Period”).  

 

 

  1. How to Enter by Phone: To enter the Sweepstakes by phone, call 1-877-WIN-MANI (1-877-946-6264) toll free from your home or mobile phone.  Follow the automated system to play the game (select “special case” 1 through 5) and/or search for deals.  For every correct guess submitted, you will receive one (1) entry into the corresponding Grand Prize random drawing (determined by date and time of entry). Entries must be complete and received by 11:59 p.m. ET each day during the Sweepstakes Period, to be eligible for that weekday daily drawing with the exception of entries made on Fridays, Saturdays and Sundays, which will all be included in one weekend drawing. Only correct guesses of the “special case” number will be eligible for the corresponding Grand Prize drawing. 

 

  1. How to Enter Online:  To enter the Sweepstakes online, visit www.mydealmania.com and follow the instructions to play the game by selecting the “special case” (1 through 5). For every correct guess submitted online, you will receive one (1) entry into the corresponding Grand Prize random drawing (determined by date and time of entry). Entries must be complete and received by 11:59 p.m. ET each day during the Sweepstakes Period, to be eligible for that weekday daily drawing with the exception of entries made on Fridays, Saturdays and Sundays, which will all be included in one (1) weekend drawing.  Only correct guesses of the “special case” number will be eligible for the corresponding Grand Prize drawing. 

 

Limit five (5) entries [excluding Bonus Entries (as defined below)] per person/phone number, per day,  or by toll-free number. There is no limit to the number of times you may enter online per day.

 

  1. Bonus Entries: You will have the option to complete a user profile online at www.mydealmania.com. If you complete the user profile online, you will going forward, earn an additional entry (each a “Bonus Entry”) for each method of entry you complete above.  Furthermore, if you choose to opt-in for Deal Pass you will, going forward, earn another Bonus Entry for each method of entry you complete above.

 

Conditions for Participation and Validation of Entries. Entries generated by a script, macro, robotic or other automated means will be disqualified. You may enter up to the limit of entries set out above, systems permitting, however, USE OF COMPUTER PROGRAMS TO ENTER AND/OR OTHER AUTOMATIC ENTRY METHODS (SUCH AS HACKS OR BOTS), REGARDLESS OF METHOD OF ENTRY, IS STRICTLY PROHIBITED.  Sponsor reserves the right to disqualify, and block or discard any entries from any individual who enters by any kind of electronic, mechanical or other automated means or otherwise tampers with or hacks the entry process as determined by the Sponsor in its sole discretion. Sponsor also reserves the right, in its sole discretion, to cancel, modify or suspend the Internet and/or phone  portions of the Sweepstakes in the event of a computer virus, bugs, tampering, unauthorized intervention, fraud, technical or system failure or disruption, force majeure or any other causes which, in Sponsor’s sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Sweepstakes.  CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor is not responsible for late, lost and/or incomplete entries, which will be disqualified.    

 

  1. Random Drawings: There will be one hundred and ninety-eight (198) Grand Prize drawings, each to award a Sponsor selected prize valued at one thousand dollars ($1,000) [one (1) per each Monday, Tuesday Wednesday, Thursday and each weekend (being Friday, Saturday and Sunday) during the Sweepstakes Period]. Drawings will be conducted from among all eligible entries received for each day/weekend during that week (i.e., first drawing will be for Monday, November 30, 2009; second drawing will be for Tuesday, December 1, 2009, etc.). Don Jagoda Associates, Inc., whose decisions will be final and binding in all matters related to this Sweepstakes, will randomly select the potential Grand Prize winner for each previous week's day/weekend on Mondays, beginning December 7, 2009 and ending August 30, 2010. The drawings for the final Monday (August 30th),Tuesday (August 31st) and Wednesday (September 1st) drawings will occur on September 2, 2010. Entrants selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.  All federal, state, provincial, municipal and local taxes are the sole responsibility of the winners.

 

  1. Prizes: (198) Grand Prizes (1 awarded per each Monday, Tuesday, Wednesday, Thursday and each weekend from 11/30/09 through 8/31/10) - a Sponsor selected prize valued at approx. one thousand dollars ($1,000). Total value of all Prizes for the entire Sweepstakes Period is one hundred ninety eight thousand dollars  ($198,000). Limit one Grand Prize per person. In the event a winner is deemed a minor in his/her state/province of residence, prize will be awarded in the name of such minor’s parent/legal guardian. Sweepstakes prizes are non-transferable, non-refundable and no substitutions by entrants will be permitted.  Sponsor reserves the right to substitute prize of equal or greater value in the event of prize unavailability. 

 

  1. Winner Notification: Potential Grand Prize winners will be notified by phone.  Don Jagoda Associates, Inc. will make two (2) attempts within a 48-hour period to contact the potential Grand Prize winners at the phone number or email address provided online or at the cell phone number or home phone number used to enter within one (1) day from the time potential winner selection was accomplished. One message will be left. Potential winner must provide all truthful information on the phone call and this information provided by potential winner will be relied upon by Sponsor as confirmation of winner’s eligibility. If potential winner is deemed ineligible for any reason on the phone call, he/she will be disqualified and an alternate potential winner will be selected. If Don Jagoda Associates, Inc. is unable to reach a potential Grand Prize winner via phone within this time frame, he/she will be disqualified and an alternate potential winner will be selected. All potential Grand Prize winners (or the potential winner’s parent/legal guardian if such potential winner is a minor in his/her state of residence) will be required to execute and return a notarized affidavit (or, for residents of Canada, a Declaration) of eligibility/release of liability and/or publicity release (where legal) within ten (10) days [twenty (20) days for Canadian winners] of attempted notification. If a winner is a Canadian resident, he/she must answer unaided a time-limited arithmetic skill-testing question as a condition to receiving a prize. If any potential winner cannot be contacted or fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, potential winner forfeits prize.  If prize is returned as undeliverable, potential winner forfeits prize.  In the event that any potential winner is disqualified for any reason, Sponsor will award the prize to an alternate winner (selected from among all remaining eligible entries received for that Grand Prize). Odds of winning a Grand Prize depend on number of eligible entries received for each day/weekend.

 

  1. General Conditions:

 

    1. By entering, entrants fully and unconditionally agree and accept to be bound by these complete Official Rules and the decisions of Sponsor, which shall be final.  Sponsor has the right to modify these rules in its sole discretion for clarification purposes at any time without materially affecting the terms and conditions of the Sweepstakes.

 

    1. Except where prohibited, all winners grant to Sweepstakes Entities and their designees the right to use, and publish his or her proper name, likeness, voice, opinions, biographical information and state and announce on-air winner’s name, home city and state in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, notification, or permission. 

 

    1. Entrants enter at their own risk. Sweepstakes Entities are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incorrect, incomplete, ineligible or unintelligible entries; (ii) telephone, electronic, hardware, software program, network, Internet or computer failures or difficulties; (iii) errors or delays in transmission; (iv) any condition caused by events beyond the control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use or misuse of a prize, or from participation in the Sweepstakes; or (vi) any printing or typographical error in any materials associated with these Official Rules or the Sweepstakes generally.  Entrants assume all liability for any injury or damages caused or claimed to be caused by their participation in the Sweepstakes and/or the acceptance and/or use of any prize, and release Sweepstakes Entities and their respective officers, directors, employees, parents, subsidiaries and affiliates from any and all such liability.  Sweepstakes Entities and their respective officers, directors, employees, parents, subsidiaries and affiliates assume no responsibility for any injury or damage to participants or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with this Sweepstakes.

 

d.       TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENTRANTS, THEIR HEIRS, NEXT OF KIN, SPOUSE, GUARDIANS, LEGAL REPRESENTATIVES, EXECUTORS, AND ADMINISTRATORS ("RELEASING PARTIES") HEREBY RELEASE THE SWEEPSTAKES ENTITIES FROM ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LIABILITIES, LOSSES, COSTS AND EXPENSES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES) ARISING OUT OF, RESULTING FROM, OR BY REASON OF THEIR PARTICIPATION IN THE SWEEPSTAKES, INCLUDING, WITHOUT LIMITATION TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RELEASING PARTIES IRREVOCABLY AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS THE SWEEPSTAKES ENTITIES FROM AND AGAINST ANY AND ALL CLAIMS BY WHOMEVER ASSERTED, INCLUDING, WITHOUT LIMITATION, ANY CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SWEEPSTAKES.

 

    1. PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES, ONLINE OR VIA PHONE, OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE SWEEPSTAKES OR A DELAY IN THE PROCESSING OF ENTRIES SUCH THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE.  SPONSOR IS NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS.

 

    1. Sponsor may prohibit any entrant or potential entrant from participating in the Sweepstakes, if at the sole discretion of Sponsor, such person shows a disregard for these Official Rules, or acts (1) with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsor, or its agents or representatives; or (2) in any other disruptive manner.

 

    1. In the event of a dispute as to the identity of an entrant entering via the methods set forth above in Rules #4, #5 and #6, the authorized account holder of the cellular phone number, email address or home phone number used to enter, if applicable, will be deemed to be the entrant.  “Authorized account holder” of a cellular phone or home phone is the natural person in whose name the phone has been issued and to whom services are billed.  “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

 

    1. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of California without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of California. Sponsors’ decisions as to all matters related to the administration of the Sweepstakes and selection of the prize winners are final.
